Secret Recall of Children's Tylenol Sparks Lawsuit

n a scorching complaint that cites internal company memos, parents say their child died because Johnson & Johnson issued a "phantom or stealth recall" of tainted Children's Tylenol, buying up the drugs from stores on the sly without issuing a recall, "so the general public, ignorant of the dangers, would continue buying and administering these brand name drugs to their children."

Daniel and Katy Moore say their 2-year-old son River died of liver failure in July 2010, the day after he took Children's Tylenol.

They sued Johnson & Johnson, McNeil Consumer Healthcare, Costco and a long list of others in the chain of supply and distribution, and third-party contractors who allegedly bought up the over-the-counter drugs in the "phantom recall."

"Defendant Johnson & Johnson, a Fortune 50 Company with $60 billion in annual sales, knew of defects, impurities and contamination in the children's drugs and, yet, embarked on a 'phantom' or 'stealth' recall of these drugs to hide these problems so the general public, ignorant of the dangers, would continue buying and administering these brand name drugs to their children," the complaint states.

Katy Moore says she gave Tylenol to her son River on July 22, 2010. Within 30 minutes, River was splitting up blood and he died the next day due to liver failure. River's parents claim the Tylenol destroyed his liver.

They claim the defendants ignored deplorable manufacturing conditions and had numerous recalls of its products, including its infants and children's Tylenol.

River's parents claim Johnson & Johnson and its McNeil subsidiary hired contractors to secretly go into stores that stocked the tainted products, buy up all the products and not mention the recall to anyone.

"This clandestine phantom/stealth recall was done without notification to the customers or the retailers to avoid the public shame, the financial impact and regulatory ramifications of a formal recall," the complaint states.

It continues: "the purpose of the phantom/stealth recall is evidenced in an internal email in which a McNeil executive said, 'We are just trying to prevent a recall and a lot of expended dollars.'

"In another email, a McNeil executive described the success of the phantom/stealth recall by saying, 'This was a major win for us as it limits the press that will be seen.'

"On May 27, 2009, defendant Peter Luther sent an email approving the unethical phantom/stealth recall and instructed, 'Let's make this happen ASAP.'

"Defendant Luther, who defendant Weldon praised as being a loyal J&J employee, was not fired for his intimate roll [sic] in the phantom/stealth recall."

Weldon is chairman and CEO of Johnson & Johnson, Luther the president of its McNeil subsidiary, according to the complaint.

The complaint continues: "At the direction of J&J and McNeil's third-party contractors, including [defendants] Inmar Inc., WIS International, and CSCS [Carolina Supply Chain Services], visited various retail outlets and purchased all of the Motrin IB in the store, acting like regular customers.

"J&J and McNeil directed their third-party contractors, including Inmar Inc., WIS International, and CSCS, not to discuss their purchases as being a recall of the product.

"Indeed, J&J's specific instructions to the contractors hired to perform the phantom recall indicated that they were to 'quickly enter each store, find ALL of the Motrin product described, make the purchase transaction, secure the receipt, and leave ... THERE MUST BE NO MENTION OF THIS BEING A RECALL OF THE PRODUCT!' [Ellipsis in complaint.]

"J&J and McNeil subsequently misrepresented to the FDA that their third-party contractors were merely performing an audit of retailers to determine whether McNeil should initiate a formal recall.

"The FDA eventually became aware of the phantom/stealth recall when it received a copy of an internal memo containing the above instructions and confronted McNeil regarding those activities.

"On July 9, 2009, as a result of the above, McNeil publicly recalled the Motrin IB, at a delay of approximately 8 months.

"This phantom/stealth recall, in part, spurred the House Committee on Oversight and Government Reform to conduct a congressional investigation and hold two separate congressional hearings in 2010."

But River's parents say it was too little, too late for their son.

"Johnson & Johnson and its highly compensated executive knew of the problems with their products, and instead intentionally decided to gamble with River Moore's life because they were more concerned with company profits and meeting the Wall Street analysts' earnings projections, than the health and safety of American children," the complaint states.

"As a result, the contaminated Children's Tylenol, which never should have been on the market in the first place, caused River Moore's liver failure and death."

River's parents seek punitive damages for product liability, recklessness, breach of warranty, negligent infliction of emotional distress, violation of consumer protection law, civil conspiracy and wrongful death. They are represented by Thomas Sweeney with Messa & Associates.

Defendants include Johnson & Johnson, McNeil-PPC Inc., McNeil Consumer Healthcare, McNeil Consumer & Specialty Pharmaceuticals - a division of McNeil PPC Inc., Costco Wholesale Corporation, Inmar Inc., Carolina Supply Chain Services, Carolina Logistics Services, WIS International and eight Johnson & Johnson officials.

If these products are manufactured by the same companies, maybe the Tylenol was mispackaged as Motrin IB. The reporter could be citing an internal memo related to a different recall (his mistake, but indication of more than one unpublicized issue). The important point is the "phantom recall" left the public clueless about what sounds like a dangerous manufacturing/ packaging problem. I don't hear anyone denying the claims, and it is unconscionable to put profit before the safety of children.

What an absolutely terrible story. Let's hope J&J and all the defendents are found guilty, but when are the executives going to jail?? No amount of money will compensate the victims family but if corporate executives know that they can go to jail for years and years, maybe they'll think twice before the engage in another "stealth" recall.

Yes, why bother with a trial. Lets just base our "hope' that they are found guilty based on the highly biased claim by the litigants and their attorneys who no doubt hope to become multimillionair es based on massive punitive damages. I fail to see where there is any proof that tainted Tylenol caused this unfortunate death.

From WebMD it would seem that the cause of Fulminant Hepatic Failure in kids is largely unknown. Taking the Tylenol may have been purely a coincidence.

Your assumption is incorrect. I would just like to see some evidence first unlike many here who just assume that a corporation is guilty. To assume cause and effect when a known condition of unknown cause "fulminant hepatitis" can lead to childhood death seems a big leap.

Yes Tylenol is toxic to the liver but usually that occurs with chronic heavy use for decades in the presence of other risk factors such as alcohol use.

@HJ7: You're sounding like a corporate shill doing damage control. Per the Washington Post, River Moore died of a "super dose" of acetaminophen. Testing done before and after death showed symptoms that would occur do to excessive acetaminphen, and not some underlying medical condition. Here's the article:

The fact that the product was "not recalled" is odd but that it got onto the market is horrific.

Another festering pimple on our "justice" system to add to the thieves in Banking, laws passed to suppress voters' rights, laws passed to tell "us" what we can do with our bodies (based on somebody's "religious" something) and so it goes.

What is absolutely amazing is that this Tylenol "nonsense" has been going on since 1982 (the first recall) and. . .BOTH the medical community AND the American Public are so stupid as to still be buying the crap!!!

The death of River Moore was tragic and so unnecessary. Yet, Republicans call for further deregulation, while Libertarians argue that companies will simply regulate themselves. If the Moores' complaint holds up in court — and, if we can still trust in our courts, there is every indication that it will — this case will show just how wrong Republicans and Libertarians are about the need for government oversight of business practices.

Something's missing here. If Tylenol killed the little boy, why is Motrin IB being taken out of the stores? Motrin is ibuprofen; Tylenol is acetaminophen. Are they both dangerous? Or is it McNeil's manufacturing process that is being fingered? This story needs more clarification.

No I am suggesting we wait for the evidence and if there was a secret recall find out the reason for it. It might have been for something trivial like a packaging error. For example if they had an incorrect spelling they might want to get a product back without alarming the public.

Just another case where quarterly profits are worth much more than a bunch of kids lives. Weldon & Luther's kids were safe, damn the rest of them. Grubby little mongols anyway. Better off without them......

J&J will now receive the standard 2 million dollar fine & have to promise to not do that again. They'll take it out of their $50 million government subsidy/welfare check so we'll actually be paying the fine.

And, we won't be seeing any class action lawsuits against these fine men either. The Supreme beings made sure of that.......

Ver poor story but Tylenol has warned of liver disease for over 30 years. In past 10 years for children esp.
Motrin has in past 7 years done something wrong, I read some info the other day to see if my motrin 800 would counter act with
new med. It said do not take and I read further...I have not had Motrin for over 7 mths, and will no longer.
Many of this crap is made overseas, that is a reason I will not buy generic...or get flu shots. Reports are available, got to look before you take not after

If the parents of this child had taken generic acetaminophen they might have avoided this problem. The lawsuit isn't against all manufacturers of acetaminophen. It's against Tylenol.

To be sure, this is a truly tragic story. My heart goes out to the parents, and to all those who have suffered similar fates over many years.

The solution is simple: We need to pass a Federal Law, so that it applies to ALL States, that says that if an executive of a corporation knowingly acts in a way that endangers the safety of others, they are subject to full crimminal prosecution. No more corporate shields for this sort of murderous mis-behavior. At the very least, any executive level person who knew about this and did not either try to bring it to light or stop it before the fact needs to be indicted for manslaughter. Until that level of accountability is assured, this will continue to happen over and over again. the execs running these large corporations will almost always choose profits over safety and ethics. In fact, undedr the current way thigs are run, they will be fired by the shareholders if they do not! Time for some big changes...

This is an amazing stream of comments. Not one person asked the essential questions: what evidence exists (a) that the product given to River was one of the contaminated products, and (b) the contamination caused or contributed to his horrible death?

Contamination can be many things, some not dangerous but still unacceptable in food or drugs. River may have had an allergic reaction that had nothing to do with contamination or the reasons for the recalls. Or River may have had a medical condition - acute, or a chronic condition that would make Motrin or Tylenol deadly to him. The article presents a very incomplete picture at best, and nothing to support claims of contamination or how it caused such rapid death.

While mega-corporations are dangerous to our life, liberty and prosperity, so are angry mobs that decide guilt and burn their targets at the stake before examining - or even asking for - proof beyond a reasonable doubt. Guilt by association - even temporal association - isn't the same thing.

Lets get the facts first, THEN prosecute the hell out of the people who are responsible... based on the evidence. Otherwise we are no better than the people who convicted and executed Troy Davis in Georgia. Executing people out of prejudice and hatred isn't exactly moral high ground...

Number one the side panel on Tylenol for thirty years has warned of Liver Disease from use. Pretty sad no one paid attention as it is in writing.
Then on TV, in Papers over past 20 years of the bad testing of Tylenol since it has adverse side affects of Liver Disease even Death.
Within 5 years, David Letterman brought in Tylenol Products, he said I have a bad cold, I bought Tylenol for colds, then he on TV read the label, he didnot stop with Adult but also brought up Tylenol for kids. He asked people about this, has made comments for over 5 years. This has been on TV, Media for decades, now you picked up on consequences of Tylenol on children when there has been case studies of children ending up with liver failure for over twenty years?
When I was on Interferon, my doctor said to take tylenol...I said I would rather drink arsenic.
They have had some adverse side affects on certain Motrin Products, that Media you all bash, has written/spoke of it. There is plenty of documentation on all products if you take the time to read it.

Story was jumbled, not well written or edited. I do not believe it can actually kill overnight but each of our bodies is different. The Loss of Child is what counts,grief of parents. However, there are plenty of good natural products to give, clinics to go to. Aspirin is still the best fever beater, I do not know the facts of case but before stories are written, facts should be included

We tell people by Media, News, Protests about Nuclear bs, about Chemicals for food or drugs. We warn people.
Government used to regulate now they do whatever they want and get paid by us and the lobby. So just what do you want me to do. I send letters daily to Congress, Senate of Fed and State. I just did some for Buffalo, Artic, Wolves.

Go and buy Health Food Store Products, stop buying OVC or Prescriptions. Need a prescription, question your doctor, read label, read the information of where it is made, components and decide. Butr most of the people on these type of sights like to hear themselves write. They do nothing but they have opinions. It is good but their inactions is why this Country is in the shape it is. I laugh at most of the comments esp the OWS since I know most text loud but do nothing. I would guess that of all RSN bloggers only 1% actually do anything but hear themselves text!

Bull There are other alternatives and all you need to do is go to a Natural Homeopathic Doctor. They actually go to Medical School and beyond to study Homeopathic Medicine.
I have fought two diseases with formats of Homeopathic than the meds from USA only, back to Natural. I beat the diseases. I have had 12 operations. My doctor's couldnot believe my recovery and I took none of their meds. Now they sell good, organic vitamins and minerals have better results.
Just because a doctor says to take these two doesnot mean there is no Bayers Children Aspirin. I keep on hand in case I would feel tightness in my chest.
It is said if you take two childrens, and a glass of water you can actually if you wait at door be in good shape when ambulance comes. In fact, study proves you can stave off actual heart attack.
Bayers Children still beats fevers over any other .... So perhaps you in your mind believe there is only two options but that is bull. Get some education, Indians have lived longer lives without Pharmacies. Asian medicine is curing lyme disease and starter hep c better than any Chemical can.

I'll stick with our pediatrician. Almost no medications are considered acceptable for young children anymore. I don't think even Bayers Children is considered safe for an infant. I may be wrong.

Do any of you have any clue that there is aluminum of large doses in your antiperspirant to cause a build up and perhaps altzeimers?
There was a warning 2 years ago about buying deodorant for kids. I looked into it as my two grandsons are getting to age, one is. I got the best deodorant on market with lowest rating. I check periodically as anything can change. Health Stores sell deodorant with no aluminum in product.
There is the Shampoos and Conditioners that have arsenic and other lovely, deadly organic matter in them. Media warned you Have any of you looked into that, many were the phony high dollar crap.
I always thought the quality of life for my family came first, so I Question Authority, pays off.
I do more than sit around on a computer, or cell phone. I actually go amongst the living, go to Holistic Meetings, read up info my Health Store gives, go to Organic Farms. I live in North East and I am still eating fresh veggies.

Opinions are cute. Knowledge before hand is an opportunity we have, do not use. Right now I am going to help my husband beat Heart Disease. Because you can, thru work, effort, and Natural Eating. My Friends are living with Cancer, Leukemia, Hepatitis and other Disorders the same way...Intelligently.

Hi Kitt, Im an avid believer in looking into non-pharmaceutical methods of getting well and staying well. My opinion is organic, homegrown, and homeopathic ways are better. Eat natural, organic, and read labels. I found prickly pear/nopal juice is wonderful for inflammation and been feeling so much better since using it. I advocate natural, this juice has me on no diabetes meds, no blood pressure meds, and no cholestrol meds...and actually benefits my vital organs. Thats only 1 product, that helped with so many ailments, and also took my arthritis pain virtually away.

I am a believer in questioning doctors and OTC meds and whats in the products we use. I think knowledge is power, and the more information you share with others the more they can help themselves. Im not looking for an arguement just sharing my thoughts.

My opinion is doctors work for the drug companies and try to shell out as much of their crap as they can to get bonuses from drug companies. I no longer think that doctors have my best interest at heart. So they give me a med that reduces my blood pressure but damages my kidneys, or that reduces my cholestrol but can damage other parts of my body. Im not in to trading one ailment for another that can damage my vital organs. As I said its my opinion, others can believe whatever they want. I know though doctors arent what they used to be. They are drug company owned and operated.

You have evidence for this opinion? Up here in Canada it would be illegal and a quick way to loose your licence. It would also mean that the drug companies would have to have access to all the pharmacy records in order to know who is prescribing what. Again illegal as it would be against confidentiality rules. The only time the drug companies know what an MD is prescribing is when they are asked by that MD to provide FREE drugs on compassionate grounds. (Something many drug companies will do.) Hardly a money maker. Up here,
the drug companies are not even allowed to give out trivial gifts such as pens etc.

Im in the US and drugs are advertised on TV all the time. First off I said it was my opinion and secondly its my personal experience. Unless you have been on more then a few meds at a time...You dont know. If your opinion is different then mine then your experience has probably been different then mine. Im on all natural herbs and juices and Im actually getting better rather then masking my symptoms with meds that damage other organs. So thats where Im at. You dont have to agree with me, I feel awesome these days, thats all I care about, before I could barely function.

Some of us work in a corporate marketing department, do we? The campaign itself seems prima facie that an unusual issue existed with the Tylenol not to mention the correspondence confirming that a recall would otherwise be required so, regarding 'proof' of the quality of the product, the company's own actions testify powerfully to that. Not comparable to any individual's actions as per your comparison. Guilt presumed by association at the higher levels of ANY corporation, which are sieves for talented psychopaths. Besides, what real red-blooded American rues a little 'collateral' damage, women and children first?

The outcome here will depend on the judge. For the classic case of this kind of psychopathic corporate thinking, look up the A.H. Robbins Company and the Dalkon Shield, an IUD that was killing young women with something called PIDS with full knowledge of A.H. Robbins management who did nothing, not even such as this. Of course, they were Southerners. When sued, they tried to stonewall and obfuscate and lie and refuse to show records as these Big Pharma drug pushers will do. A modern unsung American hero, Federal Judge Miles Lord of the Minnesota District said essentially "Bullshit". He adjourned court in Minnesota and reconvened the court in the Virginia headquarters of A.H. Robbins itself where all records were kept and the case against the psychopaths was soon proven.

Got to hear him speak once after he retired. Interesting guy

Yet in spite of this huge conspiracy life expectancy continues to increase.

I agree with the drugs thing, the Mexican and other drug cartels are doing enormous harm but those are illegal businesses.

PS anyone who truly believes in this vast conspiracy to poison everything should invest in a tin foil hat to keep the CIA mind control waves out.
